  • Agency Adoptions - Private adoption agencies are regulated by the state of Illinois and licensed to provide information and advice to prospective adoptive parents. These agencies can accept children that have been surrendered by their birth parents and place these children in adoptive parents' homes, and they also provide supervision of adoptive families and post-adoption support services.
  • Private Adoptions - These situations are also referred to as independent adoptions, in which adoptive parents and biological parents interact directly without going through an adoption agency. In these cases, strict legal procedures must be followed to ensure that all parties' rights are protected and undesirable consequences are avoided.
  • Related Adoptions - In these cases, one or both adoptive parents are related to the child. This can include step-parent adoptions or situations in which a brother, sister, grandparent, aunt, uncle, or cousin is an adoptive parent.
  • Adult Adoptions - In cases where an adoptive child is at least 18 years old, one of the adoptive parents must be related to the child, or they must have resided with the child for at least two years. In adult adoptions, biological parents do not need to be notified or give consent.
  • Co-parent Adoptions - These situations are also referred to as second parent adoptions, in which unmarried partners adopt a child together. These can include same-sex partners or other unmarried couples. Some counties in Illinois do not allow unrelated co-parent adoptions, so prospective adoptive parents in these cases should consult an attorney to understand their legal options.
  • Adoptions of Children With an Absent Biological Parent - If one parent is no longer involved in their child's life following a divorce, the spouse or partner of the other parent may wish to adopt the child, and this can be done with or without the absent parent's consent.
  • Vacating or Reversing an Adoption - In some situations, one of the parties involved may wish to reverse an adoption after the fact. If a biological father was not provided with notice of his child's birth, if a parent agreed to the adoption under duress, or if there was another reason one of the parties believes the adoption should not have been valid, they can petition the court to vacate the adoption. In these cases, adoptive parents will need a skilled attorney to represent their family.
