Wheaton Premarital Agreements Attorney

Naperville Law Firm Assisting Clients With Prenuptial Agreements

West Chicago Prenuptial Agreement Lawyer

When a couple is planning to get married, they may wish to set down an agreement on how certain matters will be handled in case they ever divorce or one spouse dies. This is known as a premarital or prenuptial agreement (also often referred to as a "pre-nup"), and in Illinois, these agreements are governed by the Illinois Uniform Premarital Agreement Act (750 ILCS 10/).

At Anderson and Associates, P.C., our skilled family law attorneys have over 30 years of experience drafting and litigating prenuptial agreements, and we can help clients understand their rights and requirements and help them create an agreement that protects the best interests of their family.

Do You Need a Prenuptial Agreement?

A premarital agreement can cover a wide variety of issues, including the ownership of property or the amount and duration of spousal maintenance in the case of divorce. These agreements can be especially beneficial in certain situations, including:

  • Spouses with high-value assets - If either spouse owns significant assets prior to getting married, they may wish to protect these assets if the marriage ends in divorce, or they may want to specify what will happen to these assets following their death.
  • Family-owned businesses - Spouses with significant interests in a business that they or a family member own may wish to protect those interests and ensure that the business will survive the possible dissolution of their marriage.
  • Children from a prior marriage - Parents will want to be sure their children are provided for, and a premarital agreement can protect the rights of children from either spouse's prior relationships and ensure they will inherit certain assets following a spouse's death.
  • Remarriage - If spouses are getting married for a second or subsequent time, a prenuptial agreement allows them to plan the financial aspects of their upcoming marriage and ensure that their family's interests will be protected, no matter what happens in the future.
