What If I Don’t Know Where My Spouse Lives?

Pursuing a Divorce by Publication in Illinois

If you do not know where your spouse is currently living, it may still be possible for you to obtain a divorce. You must first make reasonable efforts to find your spouse and serve him or her with notice of the pending divorce. If your efforts are unsuccessful, the judge may grant you a divorce by publication.

It is not uncommon for spouses to go their separate ways before their marriage is legally dissolved. In most cases, the spouse who files for divorce has at least some idea of where to find the other party so that he or she can be served with notice of the filing. Sometimes, however, the other spouse cannot be easily located, but this does not mean that divorce is impossible.

A filing spouse must show the court that he or she has made the effort to find the other spouse before the court can allow a divorce by publication. A divorce by publication begins with posting notices in local newspapers near the last known address of the other spouse. Once these notices have run for a certain period of time, the court may enter a default judgment of divorce. It is important to note that while a default judgment may legally terminate your marriage, it does not automatically resolve all of the other issues associated with divorce. Concerns such as parental responsibilities, child support, and the division of marital property may be reserved for future consideration by the court.
